The Struggle for the Soul of America: The Democrats’ Silver Lining in the Vote to Reopen the Government

Most Democrats were upset, if not outraged, that eight Senate Democrats voted with the Republicans for the Continuing Resolution (CR) that reopened the government. Reopening the government took the pressure off the Republicans to negotiate extending the Obamacare (ACA) subsidies for millions of Americans to the dismay of a great many on the Blue Team.

            I believe, however, that there is an impactful silver lining for the Dems which may make that vote significantly better for them than initially appeared.

First, the Continuing Resolution brought the House of Representatives back into session. That eliminated House Speaker Johnson’s excuse of a government shutdown for not swearing in Democratic Rep. Adelita Grijalva.[1] Once sworn in, Rep. Grijalva became the 218th House member to sign the discharge petition, which was required to force a vote on releasing the Epstein files.[2] That vote will happen this week and compel Republican members to publicly take a stand. They can vote to release the files and hold the wealthy men, possibly including President Trump, accountable for their involvement in the illegal sex trafficking of underage girls. Or they can vote to keep the files closed and shield those powerful men from criminal liability, a vote that will not sit well with most Americans.

            Second, ending the shutdown will greatly reduce the suffering and duress that confronted a huge number of Americans. Thousands of federal workers are going back to work and will receive paychecks. More than 40 million Americans will now receive their food assistance under SNAP, though new rules may cause many of them to permanently lose those benefits in the coming months.[3] And, the chaos at airports over the holidays will gradually lessen as more air traffic controllers go back to work, though it going to take some time before air traffic gets back to normal. Still, the suffering and duress would have been worse if the shutdown had continued. And, who knew for how long.

            Third and lastly, but perhaps most important, the CR terminates the end of January 2026, less than three months from now. According to one observer, a “clear outcome of the government shutdown fight is that Americans are now far more likely to hold Republicans responsible for their rising health care premiums.”[4] If the Republicans do not negotiate an extension of the ACA subsidies in the next two and a half months and millions of Americans see skyrocketing health insurance premiums or lose their coverage altogether, the GOP will clearly shoulder the blame just as the 2026 mid-term election season begins to heat up. Polls indicate that 48% of Americans blamed Trump and the Republicans as opposed to only 34% the Democrats for the recent shutdown.[5]

            Until now, the Republicans have refused to negotiate an extension of the subsidies. The CR, in effect, gave them a reprieve. Failing to agree to help millions of voters with their huge healthcare costs could prove disastrous for the GOP in next year’s elections. In effect, agreeing to reopen the government has strengthened the Democrats’ hand both in the fight to extend the ACA subsidies and in the battle for control of Congress in next year’s elections.

The Struggle for the Soul of America: How Harris and the Dems Beat Trump

Getting out the vote is the key to winning the presidential election. If Vice President Harris can get the constituencies that strongly support her out to the polls in great numbers, she will be victorious come November. That is particularly critical in the seven battleground states of Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania and Wisconsin, which will determine the outcome.

Forty-one million members of the Gen-Z generation will be eligible to vote in this year’s election.[1] Young voters under the age of 35 account for roughly 29% of the national electorate.[2] Today’s young people are among the most electorally engaged in recent decades.[3] They support Harris over Trump by 50% to 34%.[4] With a 16% margin in her favor, the Harris campaign must ensure that Gen Z has a huge turnout this election.

The issues that concern young voters the most are the economy, inflation and healthcare, including access to abortion.[5] With inflation now at 2.5%, the lowest level in three years,[6] and interest rates coming down 50 basis points for the first time in four years,[7] the Democrats could produce a big youth vote that would boost their chances this November.

Another very pro-Harris group is women. Harris leads Trump among women by 13 points (48% to 35%). Women favor Harris more than men across every racial and ethnic subgroup. On the other hand, Trump leads among men by only eight points (47% to 39%).[8]

The top three issues for all women in this election are the economy, healthcare/reproductive rights and the cost of housing.[9] Vice President Harris strongly supports a woman’s right to choose. In addition, she has reframed healthcare as an economic issue. She has proposed capping out-of-pocket drug costs for everyone at $2,000 per year and insulin copays at $35 per month, enhancing Affordable Care Act (ACA) premium support, speeding up Medicare drug price negotiation, and expanding efforts to cancel medical debt.[10]

Harris has addressed women’s concerns regarding the high cost of housing by proposing the construction of 3 million new affordable homes with tax initiatives for builders who create them. She would also provide $25,000 down payment assistance for 4 million first-time homebuyers.[11] With a consumer-friendly platform like that, Harris’s support among women can only increase, and hopefully, among men as well.

Regarding Black voters, Harris has a huge lead with 82% indicating they support her.[12] Black women, in particular, have her back. They are working diligently to bring more black men on board as well.[13] In the Hispanic community, Harris is favored by Latinos in Spanish-speaking and bilingual households by nearly 60% compared to 32% for Trump. In English-dominant homes, 51% of respondents supported Harris, while Trump stood at 38%.[14] Harris is strongly courting non-white communities.[15]

Overall, following the September 10th debate, Harris leads Trump 50% to 45%, an increase of one or two points from prior to the debate.[16] The Vice President is addressing voters’ primary concerns, and, for the most part, they like what she is offering.

Of course, there are a few issues that are not so easy for Harris and the Dems to address. Like the Israeli-Hamas War and America’s reliance on non-renewable energy, esp. oil. So far, they have not impeded her expanding campaign to any significant degree.  

Every day it’s looking more like Kamala Harris will be the next president of the United States.

The Struggle for the Soul of America: Hold Ethically Challenged Supreme Court to Account

While we have left-leaning judges and right-leaning judges, Americans expect all judges to adhere to strict ethical standards. That would be especially true of justices who sit on the U.S. Supreme Court, the highest court in the land. Yet, the nine justices of the Supreme Court are the only judges in the country who are not bound by a written code of ethics.[1]

Chief Justice John Roberts has asserted that there is “no reason” to adopt a Supreme Court ethics code because members of his court consult a wide variety of other sources for guidance.[2] But recent revelations and events are proving him wrong.

The 25-Year Crusade to Overturn Roe v. Wade

In 1996, Rev. Rob Schenck founded Faith and Action, an ecumenical outreach ministry “to top-level government officials located in Washington, DC, throughout the United States and around the world…They seek to base their outreach on a personal relationship with the person targeted.”[3]

According to Rev. Schenck, Faith and Action aims to “win the hearts and minds of those who make public policy.” Its mission is to reintroduce the Word of God into the public debate surrounding legislation and policy matters.” It is a leader in the anti-abortion movement. Although it targets elected officials, government employees, Supreme Court justices and clerks, and other government personnel, it is a 501(c)(3) tax-exempt organization.[4]

As the leader of Faith and Action, Rev. Schenck was an effective, pro-life lobbyist working to influence members of the Supreme Court, especially Justices Alito, Scalia and Thomas. Raising over $30 million, he recruited wealthy donors and encouraged “them to invite the justices to meals, to their vacation homes or to private clubs. He advised allies to contribute money to the Supreme Court Historical Society and then mingle with justices at its functions. He ingratiated himself with court officials who could help give him access.”[5]

Mr. Schenck said “his aim was not to change minds, but rather to stiffen the resolve of the court’s conservatives in taking uncompromising stances that could eventually lead to a reversal of Roe.”[6] Apparently, he succeeded. In the Court’s recent Dobbs case overruling Roe v. Wade, Chief Justice Roberts tried unsuccessfully to limit but still save the constitutional right to abortion. The five justices to his right refused to accept Roberts’ compromise.[7]

Court Leaks Raise Serious Ethical Issues

The fact that the pending Dobbs decision was leaked in advance raises additional ethical concerns. As noted by Newsweek, the leaking of the draft opinion with the names of the five conservative justices who had already signed on to it “made it nearly impossible for any of those five justices to change their minds.”[8]

It was clearly in the interest of Justice Alito, the author of the hardline Dobbs decision, to make certain that none of his fellow conservatives had a change of heart. In fact, there was a similar advanced leak of the Hobby Lobby ruling that requiring family-owned corporations to pay for insurance covering contraception violated their religious freedoms.[9]

That 5-4 majority opinion which adversely affected the Affordable Care Act was also written by Alito in 2014. Rev. Schenck received the advance notice of the decision from a major donor who had had dinner with Justice Alito the previous night. He “used that information to prepare a public relations push“ that promoted his religious right organization.[10]

The Urgent Need for Reforming the Court

It’s bad enough that we have a Supreme Court heavily titled to the right. Now, on top of that, at least one justice appears to be very ethically compromised. In addition, Brian Fallon, executive director of Demand Justice, has called for an ethics probe into right-wing Justice Clarence Thomas’s alleged conflicts of interest in cases involving efforts to overturn the 2020 election in which his wife, Ginni, participated.[11]

Fallon thinks the Senate Judiciary Committee “should immediately move to investigate the apparent leak by Justice Alito.” He believes that “Structural reform of the court, including strict new ethics rules, is needed now more than ever.”[12]

We cannot let this go. A thorough public investigation by Congress is required, and, possibly, impeachment proceedings. Call your senators and representatives. Demand action.
